Terms & Conditions of Hire

Definitions

Company means Zero Three Event Hire. Client means the person, business, organisation or entity hiring equipment from Zero Three Event Hire. Equipment means all hire items, furniture, marquees, décor, lighting, accessories, catering equipment and any other items supplied by Zero Three Event Hire. Hire Period means the period specified on the booking confirmation, invoice or quotation. 
 

Acceptance of Terms

By accepting a quotation, paying a deposit, making a booking, or taking possession of any Equipment, the Client acknowledges and agrees to be bound by these Terms and Conditions.

Booking Confirmation

  • A booking is not confirmed until the required deposit has been received.
  • All Equipment remains subject to availability until confirmation is issued.
  • Quotations are valid for 14 days unless otherwise stated.
  • Zero Three Event Hire reserves the right to substitute Equipment with an equivalent or superior item where necessary.

Payments

  • A non-refundable booking deposit of 25% is required to secure a booking.
  • Full payment must be received no later than 7 days prior to the event date unless otherwise agreed in writing.
  • Bookings made within 7 days of the event require full payment at the time of booking.
  • Failure to make payment by the due date may result in cancellation of the booking.

Cancellations and Changes

  • Cancellations within 30 days of the event date may incur charges up to 100% of the booking value.
  • Any reductions in hire quantities within 14 days of the event date may not be eligible for a refund.
  • Requests to amend bookings are subject to equipment availability.

Delivery and Collection

  • Delivery and collection times are estimates only.
  • The Client must ensure safe and reasonable access for delivery vehicles and staff.

  • The Client or an authorised representative must be present at delivery and collection unless otherwise arranged. waiting time, stairs, long carrying distances, or special handling.

Responsibility for Equipment

  • The Client accepts full responsibility for all Equipment from the time of delivery or collection until it is returned or collected by Zero Three Event Hire.
  • The Client is liable for all loss, theft, damage, vandalism, misuse, or destruction of Equipment during the Hire Period.
  • Equipment must be kept secure, protected from weather, and used only for its intended purpose.
  • Equipment must not be altered, modified, repaired, relocated, or sub-hired without written approval.

Cleaning and Damage

  • Equipment must be returned in the same condition as supplied, excluding reasonable wear and tear.
  • Additional cleaning fees may apply for excessively dirty items.
  • The Client agrees to pay the replacement or repair cost for damaged, lost or stolen Equipment.

Marquees and Outdoor Equipment

  • Marquees, structures and outdoor Equipment must not be moved, adjusted or modified by the Client.
  • The Client must disclose any underground services, irrigation systems, pipes, cables or site hazards prior to installation.
  • Zero Three Event Hire is not responsible for damage caused by undisclosed site conditions.
  • In severe weather conditions, Zero Three Event Hire may refuse installation or require removal of Equipment where safety is at risk.

Safety

  • The Client agrees to use all Equipment safely and in accordance with any instructions provided.
  • Children must be supervised at all times around hire equipment.
  • The Client assumes responsibility for all persons using the Equipment during the Hire Period.

Risk and Liability

  • To the extent permitted by law, Zero Three Event Hire shall not be liable for any indirect, incidental, special or consequential loss arising from the use of the Equipment.
  • The Client indemnifies Zero Three Event Hire against claims, losses, damages, costs or expenses arising from the Client’s use, misuse or possession of the Equipment.
  • Nothing in these Terms excludes any rights that cannot be excluded under Australian Consumer Law.

Force Majeure

Zero Three Event Hire shall not be liable for delays, cancellations or inability to perform due to circumstances beyond its reasonable control, including but not limited to:

  • Severe weather
  • Flood
  • Fire
  • Natural disasters
  • Pandemic
  • Government restrictions
  • Industrial disputes
  • Vehicle breakdowns
  • Supplier failures

Where possible, Zero Three Event Hire will work with the Client to reschedule the booking.

Ownership

  • All Equipment remains the property of Zero Three Event Hire at all times.
  • The Client acquires no ownership rights in the Equipment.

Governing Law

  • These Terms and Conditions shall be governed by the laws of Victoria, Australia.
  • Any dispute arising under these Terms shall be subject to the jurisdiction of the courts of Victoria.
